Learning Goals

This curricular unit aims to describe and analyze the structure of the legal system-international. Students will, therefore, to understand the mechanisms that govern this system, which allows a more thorough understanding of the legal and political phenomena which pass, either by legal acts, either by acts of disorder in relation to the legal system.

Contents

1. The concept of international law. The Treaty of Westphalia until 1945 and from then until the present day.
2. The formation of international law. The sources of international law: custom, law, general principles of law, treaties.
3. Subjects of international law. The primacy of the sovereign state. People under international law. The individual and international law. International organizations.
4. Fundamental principles governing the legal-international: equality among states, the right to self-determination of peoples, prohibiting the use of force, the respect for human rights, peaceful conflict resolution, international cooperation.
5. The international community and conflict. War and international law. ius ad bellum and ius in bello.
6. The UN. Background. The UN Charter.
7. Globalization and international order. New problems. The tension between sovereignty and international community. The problem of ius cogens.

Teaching Methods

The course adheres to the strategy of curricular renewal and pedagogical innovation pioneered by the University of Évora, further strengthened by the institution's membership in the EU-GREEN European alliance. This approach emphasizes student-centered teaching and learning, focusing on developing core competencies. Consequently, the adopted methodology aims to foster essential skills such as critical thinking, intellectual independence, self-confidence, creativity, problem-solving autonomy, and collaborative teamwork.
To achieve these goals, inquiry-based and problem-based learning strategies will be integrated into classroom activities. Various tasks will be conducted through the Moodle platform, promoting both autonomous and collaborative student engagement. Additionally, there will be extensive use of digital technologies to enhance the learning experience.

Assessment

Self-regulatory assessment practices will be implemented through qualitative evaluation, with a focus on feedback that helps students improve their work.

The continuous assessment is structured as follows:
a. Participation in and completion of activities (individual and/or group) on Moodle (60%)
b. Final individual presentation (30%)
c. Participation in (10%)

The Moodle activities will be assessed based on the following criteria:
- Depth of understanding of the subject
- Relevance and clarity of content
- Logical coherence of the argument
- Originality of thought
-Bibliography.

The final assessment/exam will be an open-ended test.
