Learning Goals

The Labour Law is of particular importance in the economical, management and social fields. It is expected that the students will obtain and consolidate the knowledge of the Labour Law, not only as a whole but also in specific matters to be treated with greater development due to their special relevance. Important theoretical issues will be mentioned, but major attention will be paid to the attempt of giving the students the capacity to understand and make use of the substantive legal rules pertinent to different kinds of problems that must be considered in the area of the management of human labour. It is also expected that students develop their research capacity and strengthen their writing and speech capacities.

Contents

1. Law, labour relations and Labour Law (object and content).
2. The labour contract: legal concept, essential elements and characteristics. Distinction between the labour contract and the service contract: difficulties and solutions. Labour contracts subject to special legislation: brief notions.
3. The formation of the labour contract; incidental elements of the labour contract (the condition and the term); the legal regime of the fixed-term labour contract.
4. The employer and the employee: rights and duties.
5. The termination of the individual labour contract: some problems.

Teaching Methods

According to the nature and function of theoretical-practical classes, the contents of this unit syllabus will be subject to oral presentation, but with the constant concern to link theory to practice, showing the real interest of the issues and instilling in the students critical spirit in the analysis of the problems under study. In order to improve the functioning of the teaching sessions, it is suggested to the students the methodical study of the matters before the teaching sessions in which they will be treated. Evaluation: written paper about one of the unit subjects; oral presentation. Oral presentation will precede the delivering of the written paper. Oral presentation: 10%; written paper 90%. Previously, the students may present a draft of the paper for critical analysis and suggestions of improvement.
