Learning Goals

The Labour Law is of particular importance in the economical, business/organizational, social and political fields, both at the internal and the international level. It is expected that the students will obtain and consolidate the knowledge of the Labour Law, not only as a whole but also in specific matters to be treated with major development, because they are especially relevant in the mentioned fields. Special attention will be paid to the legal regulation of the employment relationships, the central core of the Labour Law. Relevant theoretical problems will be mentioned, but major attention will be paid to the attempt of giving the students the capacity to identify, understand and make use of the substantive legal norms pertinent to different kinds of subjects. It is also expected that students will develop their writing and speech capacities.

Contents

INTRODUCTION: Relevance of the curricular unit. Basic concepts of Law. Labour Law: object, extent and contents; formation and evolution.
SOURCES: General notions; domestic and international sources.
EMPLOYMENT CONTRACT: Concept, essential elements and characterization. Distinction between the employment contract and the contract to provide services. Contracts subject to special legislation (brief notions). Elements of the labour relationship. Labour activity, functional polyvalence, functional mobility and professional category. Formation of the contract: processes and legal demands. Invalidity. Trial period. Accidental elements: condition and term; fixed-term contracts. Rights and duties of the parties: enumeration and analysis. Working time: constraints; additional work; legal regimes of public holidays, holidays and absences. Place of work: determination and relevance; transfer. Retribution: concept, determination, compliance and non-compliance. Termination of the contract.

Teaching Methods

According to the nature and function of theoretical-practical classes, the contents this unit syllabus will be subject to oral presentation, but with de constant concern to link theory to practice, showing the real interest of the issues studied and instilling in the students the critical spirit in the analysis of the problems. The pedagogical models are listed infra. Students are encouraged to intervene, whether to put doubts or to express their points of view. To improve the functioning of the teaching sessions, it is suggested to the students the methodical study of the topics since the beginning, preferably before the teaching sessions in which they will be treated. The assessment in this unit will obey to one of two schemes chose by the students: a) Continuous assessment (requirements: attendance at 75% of the classes; minimum grade of 7 values in both tests): two written tests during the academic period; b) Assessment by final examination: oral test to be performed before a jury.
